CDM Project or Not? The Clients Duties
All construction projects require the effective management of health and safety – do you know your duties as a Client.
The client, provided competence is satisfied, can appoint an agent on their behalf. Such appointments have to be notified to the Executive under the terms of the Construction (Design and Management) Regulations1994.
Clients can appoint a competent, adequately resourced agent to carry out their CDM duties, but they retain their other duties under Health and Safety Law – such as ensuring the Health and Safety of people affected by their work. The agent must ensure a written declaration is sent to the HSE.
The Client is required to:
• Appoint a Planning Supervisor
• Appoint a Principal Contractor
The Client can appoint the same competent person to act as both Planning Supervisor and Principal Contractor. Appointments must be made AS SOON AS PRACTICABLE in compliance with the terms of the Regulations.
Every client shall ensure, so far as is reasonably practicable, that the construction phase of any project does not start unless a health and safety plan has been prepared in respect of that project. This duty cannot be transferred to any other party.
Each client shall take such steps as is reasonable to ensure that the information in any Health and Safety file which has been delivered to them is kept available for inspection by any person who may need information in the file.
