Employers' Liability Insurance
Are you aware of your obligations under the Employers' Liability Act? This piece of legislation is relevant to any employer with staff members, even those employers who are self-employed.
As an employer, you already know that you are responsible for the health and safety of your employees whilst they are at work or travelling on business. You are required by law to ensure against liability for injury or illness to employees which comes about as a result of their employment, including former employees who become ill as a result of working for you in the past.
Employees who become ill or are injured as a result of working for you can claim compensation; insurance helps safeguard you against this. Importantly, you can be fined if you do not hold a legally compliant current employers' liability insurance policy.
In addition to holding an employers' liability insurance policy, employers must carry out necessary risk assessments and take practical measures to protect their employees against illness and injury. It is also important to correctly report all incidents. These steps will help ensure that the insurer providing your policy can see you have taken legal responsibilities for the health and safety of your staff.
All employers must take Employers' Liability Insurance cover of at least £5 million. Many employers will need a greater level of cover than this.
Your Certificate of Employers' Liability Insurance must be available to all employees at any time. It is no longer necessary for Certificates to be kept for 40 years and employers no longer have to display the Certificate on the wall: they can now make it available to all staff-members in electronic form.
